Terms of Use
Last updated May 2026. GandaStay is a business service operated by AGEA Realty OPC.
These Terms of Use govern access to and use of GandaStay, a booking administration tool for accommodation businesses operated by AGEA Realty OPC ("GandaStay," "we," "us," or "our"). By accessing or using GandaStay, you agree to these terms.
1. What GandaStay Is
GandaStay is a booking administration tool for accommodation businesses. It enables independent accommodation operators to receive booking requests, manage reservations, review payment proofs, communicate with guests, and administer their property's booking workflow.
GandaStay is a platform tool. It is not a travel agency, booking intermediary, property manager, or accommodation operator. GandaStay does not own, manage, operate, or control the properties listed on its platform. Each property is owned, managed, and operated independently by the registered property owner.
2. Who May Use GandaStay
GandaStay may be used by:
- Property owners and staff — to administer bookings, manage rooms, review payment proofs, and operate their property's guest booking workflow
- Guests — to submit booking requests, track booking status, and upload payment proof through a property's booking page
Users must provide accurate and complete information when creating accounts or submitting bookings. Accounts may not be shared, transferred, or used by unauthorized persons.
3. What GandaStay Provides
GandaStay provides:
- A hosted booking page for each property
- A booking request and reservation management system
- Payment proof upload and review workflow
- Guest communication and notification tools
- Property administration and settings
- A platform for property owners and their authorized staff
GandaStay does not provide accommodation, travel services, financial services, payment processing, escrow, insurance, or guarantees of any kind related to a guest's stay.
4. What GandaStay Does Not Guarantee
GandaStay does not guarantee:
- That any booking will be accepted, confirmed, or honored by the property
- That payment proof submitted by a guest will be verified or accepted
- That a property's rooms, rates, availability, or services are accurate or current
- Any specific level of bookings, revenue, occupancy, or business outcome
- Uninterrupted, error-free, or continuously available service
- That all data entered by users is accurate, complete, or truthful
5. Property Responsibility
The property owner is solely responsible for:
- The accuracy of property information, room details, pricing, and availability
- Reviewing and confirming or rejecting payment proofs
- Guest communications, check-in, check-out, and stay experience
- Refunds, cancellations, and dispute resolution with guests
- Compliance with local laws, licensing, health, safety, and hospitality regulations
- Any harm, loss, or dispute arising from the guest's stay
GandaStay is not a party to the agreement between the guest and the property.
6. Guest Responsibility
Guests are responsible for:
- Providing accurate booking information
- Reading and understanding the property's booking terms, payment policy, and cancellation policy before submitting a booking request
- Paying the required deposit or full amount within the hold window
- Uploading clear, genuine, and correct payment proof
- Following the property's check-in, check-out, guest limit, and house rules
7. Acceptable Use
Users may not use GandaStay to:
- Submit false, fraudulent, or misleading booking information
- Upload fake, altered, or inaccurate payment proof
- Attempt to circumvent rate limiting, access controls, or platform security
- Access another user's account or booking data without authorization
- Scrape, copy, or reproduce GandaStay platform content or data
- Use GandaStay for any unlawful purpose
GandaStay may suspend or terminate access for violations of this section without prior notice.
8. Intellectual Property
GandaStay, its name, logo, interface, code, design, and content are the property of AGEA Realty OPC. Nothing in these Terms grants users any ownership, license, or right to use GandaStay's intellectual property except as necessary to use the service as intended.
9. Limitation of Liability
To the maximum extent permitted by Philippine law, GandaStay and AGEA Realty OPC shall not be liable for:
- Any indirect, incidental, special, or consequential damages
- Loss of bookings, revenue, data, guests, or business opportunities
- Harm arising from guest stays, property decisions, or payment disputes
- Platform downtime, data loss, or service interruptions
GandaStay's total liability for any claim arising from use of the platform shall not exceed the amount paid by the property for the subscription period in which the issue arose.
10. Changes to These Terms
GandaStay may update these Terms of Use at any time. Continued use of GandaStay after changes are posted constitutes acceptance of the updated terms. Material changes will be communicated with reasonable notice where possible.
11. Governing Law
These Terms are governed by the laws of the Republic of the Philippines, including the Electronic Commerce Act (RA 8792) and the Data Privacy Act of 2012 (RA 10173).
