Owner Subscription Terms
Last updated May 2026. GandaStay is a business service operated by AGEA Realty OPC.
These Subscription Terms govern the commercial relationship between GandaStay (operated by AGEA Realty OPC) and the property owner or business ("Subscriber") who activates a GandaStay subscription. By activating a subscription, you agree to these terms.
1. The Subscription
A GandaStay subscription grants the Subscriber a limited, non-exclusive, non-transferable right to access and use the GandaStay platform during the active subscription period for the purpose of administering their accommodation property's booking workflow.
The subscription is a service access right. It does not transfer ownership of any software, code, data infrastructure, or intellectual property to the Subscriber.
2. Subscription Plans and Pricing
GandaStay may offer subscription plans including free trial, standard, and other tiers. Plan features, limits, and pricing are shown at the time of activation and may be updated with reasonable prior notice.
Existing prepaid subscription periods are honored at the rate agreed at the time of payment.
3. Billing and Payment
Subscriptions are billed on the cycle selected at activation (monthly, quarterly, or annually). Fees are due at the start of each billing period.
Accepted payment methods are shown at the time of billing. GandaStay may change accepted payment methods with reasonable notice.
All fees are exclusive of applicable taxes. The Subscriber is responsible for any taxes, withholding, or government charges applicable to their subscription in their jurisdiction.
4. Auto-Renewal
Unless cancelled before the renewal date, subscriptions renew automatically for the same billing cycle. The Subscriber is responsible for managing their renewal settings within the platform.
5. Late or Failed Payment
If a subscription payment fails or is not received by the due date, GandaStay may:
- Retry the charge on the next available billing cycle
- Suspend access to the platform, including the property's guest booking page
- Restrict administrative features and booking management tools
- Terminate the subscription after a reasonable grace period
GandaStay has no obligation to maintain service access during periods of non-payment.
6. No Refund Policy
Subscription fees are non-refundable unless expressly required by applicable Philippine law or separately agreed in writing by GandaStay.
Cancelling a subscription stops future billing. Access remains active until the end of the paid subscription period. No credit or refund is issued for unused days within a paid period.
7. Free Trial
Where a free trial is offered, trial access is limited to the features and duration stated at activation. Trial access may be modified or ended at any time. GandaStay does not guarantee that trial data, settings, or configurations will be preserved after a trial ends or converts to a paid plan.
8. Plan Limits
Subscription plans may include limits on rooms, staff accounts, booking volume, storage, proof uploads, and other platform features. Exceeding plan limits may require an upgrade. GandaStay may restrict or throttle usage beyond stated limits.
9. Feature Changes
GandaStay may add, modify, remove, or replace platform features at any time. GandaStay will make reasonable efforts to communicate significant feature changes in advance. No subscription plan guarantees the permanent availability of any specific feature.
10. Suspension and Termination by GandaStay
GandaStay may suspend or terminate a subscription immediately for:
- Non-payment or repeated payment failures
- Fraudulent, abusive, or unlawful use of the platform
- Submission of false business or property information
- Actions that create legal, reputational, or security risk to GandaStay or other users
- Violation of these Subscription Terms or the GandaStay Terms of Use
11. Cancellation by Subscriber
The Subscriber may cancel their subscription at any time through the platform account settings. Cancellation stops future renewal. No refund is issued for the remaining days of the current paid period.
12. Data After Termination
Upon subscription termination or expiry:
- Platform access and the property's guest booking page will be deactivated
- Booking data, audit logs, and records may be retained by GandaStay for legal, security, accounting, and dispute-resolution purposes
- Data export availability after termination is not guaranteed unless expressly included in the subscription plan
13. No Uptime Guarantee
GandaStay is provided on an as-available basis. GandaStay makes reasonable efforts to maintain platform availability but does not guarantee uninterrupted service. No compensation is provided for outages, maintenance windows, third-party infrastructure failures, or force majeure events.
14. No Revenue or Booking Guarantee
GandaStay does not guarantee any level of bookings, guest conversion, occupancy, revenue, or business outcome. The Subscriber's results depend on their property, pricing, service, and market conditions.
15. Account Ownership
The subscription belongs to the registered property owner or business. Subscription access may not be resold, sublicensed, or shared beyond the permitted number of staff accounts in the plan.
16. Chargeback Policy
If the Subscriber initiates an unauthorized chargeback or payment dispute against a valid GandaStay subscription charge, GandaStay may immediately suspend platform access and pursue recovery of the disputed amount plus any associated fees.
17. Changes to These Terms
GandaStay may update these Subscription Terms with reasonable prior notice. Continued use of the platform after the effective date of changes constitutes acceptance of the updated terms.
